Following TMBC’s refusal of the planning application for 52 dwellings in East Malling, Kent, C&A were engaged by Esquire Developments to support the subsequent appeal, with C&A Director John Wilde instructed as Transport Expert Witness.

A public inquiry was held, with Esquire’s case presented by Sasha White KC of Landmark Chambers, supported by Poppy Kemp. Transport matters were, as expected, a key focus for local representatives, including multiple Rule 6 parties, leading to detailed examination.

After a thorough evaluation of all issues, the Inspector, Beth Davies, concluded to allow the appeal in her report issued on 22 January 2026. Reflecting on the outcome, Andy Wilford, Land and Planning Director at Esquire Developments, noted the “absolutely fantastic effort by everyone involved,” while Sasha White KC praised the “fabulous work by all the team, particularly Jessica, John [Wilde of C&A], Chris and Lucy for their wonderful evidence.”

While the decision did not place specific reliance on the emerging NPPF changes relating to rail access, it strongly reinforces the significant opportunity for sustainable development around underutilised rail stations, and the need for pragmatism when evaluating the often inherent and unavoidable constraints that historic locations typically have.

This decision will help deliver high-quality new homes for Kent residents, within a short walk of an excellent rail service providing access to London and other key towns across the county.
